Are non-compete agreements enforceable against Texas physicians?+

Yes, but only if they comply with Chapter 15.50 of the Texas Business and Commerce Code, which requires a buyout provision at a reasonable price, access to patient lists, continuity of care for specific patients, and reasonable limits on geography and duration. Non-compliant covenants are unenforceable.

What is 'tail coverage' and who should pay for it?+

Tail coverage (an Extended Reporting Endorsement) covers malpractice claims that arise after your employment ends but relate to care rendered during employment. It is often expensive — tens of thousands of dollars — and who pays is a negotiable and frequently overlooked term.

How should physician compensation be structured?+

Common models include straight salary, wRVU-based productivity, net collections, or hybrid models with base plus bonus. Each has tax, billing, and risk allocation consequences. We pressure-test the numbers before you sign.

Can the practice restrict where I work if I leave?+

Only within the limits of Texas Business and Commerce Code § 15.50. A properly drafted covenant must include a reasonable buyout and cannot deny patients ongoing care.

Do I need an attorney to review an associate agreement from a 'good' practice?+

Yes. Even reputable practices use templates that favor the employer. A one-hour review can save six or seven figures over the life of the contract.
